REQUISITE STAYS

Direct Booking Rental Agreement & Terms and Conditions

These Direct Booking Rental Agreement and Terms and Conditions ("Agreement") are between:

Requisite Stays
("Requisite Stays", "we", "us" or "our")

and

Lead Guest

("Guest", "you" or "your").

This Agreement applies to the short-term accommodation booking confirmed by Requisite Stays.

1. Booking Details

Check-in Time: 15:00 PM (UK Time)
Check-out Time: 10:00 AM (UK Time)
Number of Guests: Per booking details

The booking is confirmed once the required payment has been received and the booking confirmation has been issued.

2. Nature of the Accommodation

The accommodation is provided as short-term serviced accommodation for temporary residential, leisure, business or similar purposes.

This Agreement is intended to govern a short-term accommodation booking and does not create a tenancy or give the Guest any right to remain in the property beyond the agreed booking period.

The Guest must not use the property as their principal or permanent residence.

Where applicable, the Guest acknowledges that the accommodation is provided subject to the laws and regulations applicable to short-term serviced accommodation in the location of the property.

3. Lead Guest

The person making the booking must be at least 18 years old and is responsible for:

  • Providing accurate booking information;
  • Ensuring that all members of the group comply with this Agreement;
  • Ensuring the property is used appropriately;
  • Paying all amounts due under the booking;
  • Providing accurate guest information where requested.

The Lead Guest accepts responsibility for the conduct of everyone staying at or visiting the property.

4. Maximum Occupancy

The property must not be occupied by more people than the maximum occupancy stated in the booking.

Only the guests declared at the time of booking may stay overnight unless Requisite Stays has provided prior written approval.

Additional overnight guests may result in additional charges and/or termination of the booking.

5. Payment

Unless otherwise stated at the time of booking:

  • A booking requires payment in accordance with the payment schedule displayed at the time of reservation.
  • Any outstanding balance must be paid by the date specified in the booking confirmation.
  • Requisite Stays reserves the right to cancel a booking where required payments are not received by the applicable deadline.

All prices are displayed in pounds sterling (£).

6. Security / Damage Deposit

Where a security or damage deposit is required, the amount will be stated during the booking process.

The deposit is held as security against:

  • Damage to the property, furniture, fixtures, fittings or equipment;
  • Missing or damaged items;
  • Excessive cleaning;
  • Unauthorised guests;
  • Lost keys or access devices;
  • Smoking inside the property;
  • Unauthorised parties or events;
  • Breaches of the house rules;
  • Other reasonable costs arising from the Guest's actions or omissions.

The deposit is not a limit on the Guest's liability.

If the cost of damage or loss exceeds the security deposit, the Guest remains responsible for the additional reasonable cost.

Where no damage or other applicable charge is identified, the deposit will be released in accordance with the applicable booking/payment arrangements.

7. Cancellation by the Guest

Cancellation rights and any applicable refund will be determined by the cancellation policy displayed to the Guest at the time of booking.

Where a specific cancellation policy has been agreed or displayed during the booking process, that policy takes precedence over any general cancellation wording in this Agreement.

Any refund due will normally be made using the original payment method.

Guests are strongly encouraged to obtain appropriate travel and accommodation insurance.

8. Cancellation by Requisite Stays

Requisite Stays reserves the right to cancel a booking where:

  • Payment has not been received;
  • The booking appears fraudulent or materially inaccurate;
  • The property becomes unavailable due to circumstances outside our reasonable control;
  • The Guest materially breaches this Agreement;
  • The property is used for an unauthorised purpose;
  • The Guest exceeds the permitted occupancy;
  • There is evidence of an unauthorised party, event or commercial activity;
  • The Guest engages in threatening, abusive, illegal or seriously disruptive behaviour.

Where Requisite Stays cancels a booking for reasons unrelated to a Guest breach, any refund due will be handled in accordance with the applicable booking terms and consumer law.

9. Check-in

The property will normally be available from the check-in time stated in the booking confirmation.

Early check-in is subject to availability and is not guaranteed unless expressly confirmed by Requisite Stays.

Guests must follow the check-in instructions provided by Requisite Stays.

Access codes, keys and other access information must not be shared publicly or with unauthorised persons.

10. Check-out

Guests must vacate the property by the stated check-out time.

Late check-out is only permitted where agreed in advance.

Unauthorised late check-out may result in an additional charge where it causes costs, delays, cleaning issues or prevents another guest from accessing the property.

At check-out, Guests must:

  • Remove personal belongings;
  • Dispose of rubbish appropriately;
  • Wash or load used dishes as reasonably requested;
  • Return keys and access devices as instructed;
  • Leave the property reasonably tidy;
  • Ensure doors and windows are securely closed;
  • Follow any property-specific check-out instructions.

11. Cleaning

A standard cleaning fee may be included in the booking price.

The cleaning fee covers normal turnover cleaning following the Guest's stay.

It does not cover excessive cleaning resulting from:

  • Excessive rubbish;
  • Food or drink spills;
  • Stains;
  • Mud or excessive dirt;
  • Vomit or bodily fluids;
  • Unauthorised smoking;
  • Excessive mess;
  • Damage requiring specialist cleaning.

Reasonable additional cleaning costs may be charged to the Guest.

12. Damage, Loss and Breakages

Guests must notify Requisite Stays as soon as reasonably possible of any damage, defect or breakage discovered during their stay.

Guests must not attempt major repairs themselves.

The Guest may be charged for reasonable costs arising from damage, loss or breakage caused by the Guest or members of their party.

Where appropriate, Requisite Stays may provide photographic evidence, invoices, receipts or other reasonable evidence supporting a charge.

Normal wear and tear will not be charged to the Guest.

13. House Rules

Guests agree to comply with all property-specific house rules provided before or during the stay.

Unless expressly permitted by Requisite Stays:

No parties or events

Parties, celebrations, events, gatherings or functions are prohibited.

No smoking

Smoking and vaping are prohibited inside the property.

Evidence of smoking inside the property may result in additional cleaning, deodorising or other reasonable charges.

No illegal activity

The property must not be used for illegal activity.

No excessive noise

Guests must respect neighbours and the surrounding community.

Excessive noise, particularly during night-time hours, is prohibited.

No unauthorised commercial activity

The property must not be used for unauthorised business, filming, photography, commercial production or other commercial purposes.

No subletting

The Guest may not sublet, transfer or resell the accommodation.

14. Visitors

Day visitors may only be permitted where they comply with the property's occupancy limits and house rules.

The Lead Guest remains responsible for all visitors.

Requisite Stays may prohibit visitors where there are reasonable concerns regarding safety, security, nuisance, overcrowding or misuse of the property.

No visitor may stay overnight unless authorised.

15. Pets

Pets are not permitted in the property.

Unauthorised pets may result in additional cleaning or other reasonable charges.

Assistance/assistance-related animals will be handled in accordance with applicable law.

16. Children

Children are welcome where the property is advertised as suitable for children.

The Guest is responsible for supervising children and ensuring that they do not access areas or equipment that may present a safety risk.

Requisite Stays does not guarantee that properties are childproof unless expressly stated.

17. Personal Belongings

Guests are responsible for their own belongings.

Requisite Stays is not responsible for loss, theft or damage to personal belongings except where liability cannot lawfully be excluded or limited.

Guests should not leave valuables unattended.

Any item left behind should be reported as soon as possible.

Reasonable postage, packaging or handling charges may apply where Guests request return of forgotten belongings.

18. Keys and Access Devices

Keys, fobs, parking permits and other access devices remain the property of Requisite Stays or the relevant property owner.

Guests must not duplicate keys or access devices.

Lost keys, fobs, permits or other access devices may result in reasonable replacement or associated security costs.

Guests must immediately report lost or stolen access devices.

19. Maintenance and Repairs

Guests must promptly report maintenance issues.

Requisite Stays will take reasonable steps to address reported problems as soon as reasonably practicable.

Where a repair or maintenance issue occurs, the Guest agrees to provide reasonable access to the property for inspection, repair or maintenance, subject to applicable notice and legal requirements.

Requisite Stays will not normally provide compensation for minor maintenance issues where reasonable efforts have been made to resolve them.

20. Utilities and Equipment

Normal use of electricity, heating, hot water, Wi-Fi and other facilities is included unless otherwise stated.

Guests must use appliances, heating systems and other equipment responsibly.

Guests must not tamper with safety equipment, electrical systems, heating controls or other building systems.

21. Wi-Fi and Internet

Where Wi-Fi is provided, it is supplied as a convenience and Requisite Stays does not guarantee uninterrupted availability.

Guests must not use the internet connection for illegal activities, copyright infringement, hacking, harassment, fraud or other unlawful activity.

22. Safety and Security

Guests must comply with all safety instructions provided for the property.

Guests must not:

  • Disable smoke or carbon monoxide alarms;
  • Tamper with fire safety equipment;
  • Obstruct emergency exits;
  • Interfere with security equipment;
  • Leave external doors unsecured;
  • Engage in behaviour that creates a safety risk.

Any serious safety concern must be reported immediately.

23. Emergency Situations

In an emergency, Guests should first contact the appropriate emergency service by calling 999 where necessary.

Guests should then notify Requisite Stays as soon as reasonably possible.

Emergency contact details for the property will be provided with the booking information.

24. Right of Access

Requisite Stays, its representatives, contractors or emergency personnel may enter the property where reasonably necessary for:

  • An emergency;
  • Maintenance or repairs;
  • Safety concerns;
  • Inspection of reported damage;
  • Cleaning or servicing;
  • Other legitimate property-management purposes.

Except in an emergency, reasonable notice will normally be provided where access is required during a Guest's stay.

25. Complaints and Problems During the Stay

Guests should report any issue as soon as possible rather than waiting until the end of the stay.

This gives Requisite Stays a reasonable opportunity to investigate and, where appropriate, remedy the issue.

Complaints should be submitted using the contact details provided in the booking information.

26. Guest Conduct

Guests must behave in a respectful and responsible manner.

Requisite Stays operates a zero-tolerance approach to threatening, abusive, discriminatory or violent behaviour towards staff, contractors, neighbours or other persons.

Such behaviour may result in immediate termination of the booking without refund, subject to applicable law.

27. Accessibility

Guests should review the property description carefully before booking.

If you have accessibility requirements, mobility requirements or other specific needs, please contact Requisite Stays before booking so that we can provide information about the property and its facilities.

Requisite Stays cannot guarantee suitability unless specific arrangements have been confirmed in writing.

28. Photography, Filming and Commercial Use

Commercial photography, filming, content creation or professional production is not permitted without prior written approval.

Any approved activity may be subject to additional terms and charges.

29. CCTV and Security Devices

Where applicable, external security devices such as doorbell cameras or CCTV may be installed at the property for security and safety purposes.

Any such devices will be operated in accordance with applicable privacy and data protection requirements.

Indoor surveillance of Guests is not permitted.

Details of applicable security devices will be provided where required.

30. Data Protection

Requisite Stays may collect and process personal information necessary to:

  • Process and manage bookings;
  • Communicate with Guests;
  • Provide accommodation services;
  • Process payments;
  • Manage security and safety;
  • Meet legal and regulatory obligations;
  • Handle complaints and disputes.

Personal information will be processed in accordance with applicable UK data protection law and Requisite Stays' privacy policy.

31. Liability

Nothing in this Agreement excludes or limits liability where doing so would be unlawful.

Subject to applicable law, Requisite Stays will not be responsible for indirect or consequential losses arising from the Guest's stay.

Guests remain responsible for their own actions and the actions of members of their party and visitors.

32. Force Majeure

Requisite Stays will not be liable for failure or delay in providing accommodation where this is caused by circumstances outside its reasonable control.

This may include, but is not limited to:

  • Fire;
  • Flood;
  • Severe weather;
  • Natural disasters;
  • Utility failures;
  • Major building or infrastructure failures;
  • Government restrictions;
  • Civil emergencies;
  • Acts of terrorism;
  • War;
  • Industrial disputes;
  • Other circumstances beyond reasonable control.

Where such circumstances materially affect a booking, Requisite Stays will communicate with the Guest and take reasonable steps to address the situation.

33. Termination for Breach

Requisite Stays may terminate the Guest's stay where the Guest materially breaches this Agreement or the property's house rules.

Examples include:

  • Unauthorised parties;
  • Serious nuisance;
  • Illegal activity;
  • Smoking inside the property;
  • Unauthorised additional guests;
  • Significant property damage;
  • Threatening or abusive behaviour;
  • Failure to make required payments.

Where a booking is terminated because of a Guest breach, the Guest may remain responsible for reasonable costs and losses arising from the breach, subject to applicable law.

34. No Waiver

If Requisite Stays does not immediately enforce a provision of this Agreement, this does not mean that Requisite Stays has waived its right to enforce that provision later.

35. Changes to the Booking

Any request to change booking dates, occupancy, property or other material booking details is subject to availability and Requisite Stays' approval.

Additional charges may apply.

A booking change is not confirmed until Requisite Stays provides written confirmation.

36. Special Requests

Special requests are subject to availability and are not guaranteed unless confirmed in writing.

Examples include:

  • Early check-in;
  • Late check-out;
  • Additional bedding;
  • Additional cleaning;

37. Governing Law

This Agreement shall be governed by the laws applicable to the jurisdiction in which the accommodation property is located.

Where the property is located in Scotland, Scots law will apply.

Where the property is located in England, the law of England and Wales will apply.

Nothing in this Agreement affects any statutory rights that the Guest may have under applicable law.

38. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude or restrict any rights or protections that cannot legally be excluded or restricted under applicable consumer protection legislation.

Where a provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

39. Agreement and Acceptance

By completing a direct booking with Requisite Stays, the Guest confirms that:

  1. They have read and understood these Terms and Conditions;
  2. They agree to comply with these Terms and Conditions;
  3. They are authorised to make the booking;
  4. The information supplied during the booking process is accurate;
  5. They accept responsibility for all members of their party and their visitors;
  6. They agree to pay all applicable charges arising under the booking and this Agreement.

Where an electronic acceptance checkbox is used during the booking process, the Guest's acceptance will constitute confirmation of agreement to these Terms and Conditions.
